6.5 Determining the Child’s Age

Age determines which court hears the case, what procedures apply, and what protections the child receives. Police must therefore:

  • Request documents such as a B-Form, birth certificate or school record
  • Record the evidence and steps taken in the case diary
  • Where age remains uncertain, refer the matter for lawful age assessment

Until confirmed otherwise, the benefit of doubt must favour treating the person as a child.
